1. That the rate and basis of the Rental of rooms is as set out in Schedule 1 of this Rental Agreement. 2. That the Tenant is a registered Psychologist, Social Worker or Counsellor with professional indemnity insurance and public liability insurance, current certificates of currency are required to be returned with this Agreement. 3. That the Tenant acts at all times in accordance with the privacy and ethical guidelines of their professional governing body. 4. That files or case notes relating to clients are the sole responsibility of the practitioner and are at no time left unattended on-site. 5. That the Tenant will ensure appropriate supervision of clients, support personnel, and children attending the premises at all times. 6. The owners of The Oaks are not subject to professional and public liability in relation to the Tenants’ professional practice. 7. That all clients of the Tenant are advised that the Tenant practices independently from owners of The Oaks. 8. Where this Agreement is for an initial Rental term, the Tenant agrees to pay a one-off fee of $100 (GST included) for rental registration. 9. The Tenant will have access to the shared areas of the premises, including the waiting room, kitchen and reception area during the time of room hire. 10. The Tenant will treat the building and items there in a respectful manner and take responsibility for leaving the premises clean, tidy and secure. 11. If the basis of the Agreement is Casual, the Tenant agrees that they will book rooms ahead of their proposed session times to receive confirmation that the room is free and the Tenant agrees to pay a 50% cancellation fee for any booking cancelled within 24 hours. This must be done between 9 am and 5 pm Monday to Friday. 12. For Annual Tenants, any permanent or semi-permanent changes or variations from the Occupancy Days and times allocated in Schedule 1, must be notified and confirmed in writing giving 30 days’ notice of the requested change. This must be done between 9 am and 5 pm Monday to Friday. Any changes will be based on availability and are not automatic. 13. Changes due to unforeseen circumstances (eg. Illness) require notification in writing. This is so we have a record of our invoicing. Compensatory arrangements/changes should be advised as soon as possible and preferably before the time of booking. 14. If a Tenant is found to be on-site during a time that has not been allocated to the Tenant, their Rental privileges may be withdrawn and the Tenant will be charged for this period of time at Casual Rates. 15. The Tenant acknowledges that they will receive monthly invoices for all use of the rooms. Accounts are to be paid within 30 days of issue or bookings may be declined until the account is settled. Costs will be added if the account has to be referred to a debt collector and this action could entail the Tenant being reported to a credit reporting agency. 16. This Rental Agreement will be subject to review on an annual basis. 17. Rent is to be adjusted according to annual consumer price index 18. This Rental Agreement can be terminated by either party by the provision of 1 month’s notice in writing.
